By using our Site, you agree to the terms described on this page, as well as our Privacy Policy, which is incorporated herein. These terms are written in plain language. About Foundation
Foundation is recognized by the Internal Revenue Service as a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code. Contributions are generally tax-deductible to the extent permitted by law. Donors should consult their tax advisors regarding the deductibility of any contribution. Tax receipts are issued for qualifying donations.
Consent and Capacity
In order to use our Site, you must be at least eighteen. Your use of our Site is conditioned on your acceptance of these Terms. If you do not agree with these Terms, please discontinue your use of the Site.
Intellectual Property Rights
Foundation's trademarks, trade names, logos, and other intellectual property incorporated into the Site are the sole property of Foundation or its licensors and are protected under copyright, trademark, trade secret, and other intellectual property laws. Copying or distributing any material, illustrations, photographs, video, or content from the Site without consent is strictly prohibited. Additionally, any use that constitutes an infringement of any of the above-stated intellectual property rights is prohibited. We, in our sole discretion, reserve the right to remove any content or take any steps deemed appropriate to protect such rights.
Donations
Donations made through this site are processed by Givebutter, our fundraising platform. All transactions are subject to Givebutter's terms as well as our own. Donations are non-refundable except where required by law or where a clear error has occurred — in that case, please contact us at info@jasonkiddfoundation.com within thirty days of the transaction.
Designated Gifts
When you designate a gift to one of our four strategic pillars — Youth Sports Development, Girls Sports Equity, Leadership and Education, or Community Access — we apply your contribution to that area. In rare cases where the Foundation's needs require redirecting funds (for example, if a designated program is already at capacity), we will use the gift in a manner consistent with your original intent.

Indemnification
You agree to indemnify and hold harmless Foundation, its directors, officers, employees, representatives, agents, subsidiaries, assignors, and licensors from and against any lawsuits, disputes, claims, proceedings, demands, costs, or expenses related to or stemming from any use of the Site or your breach of these Terms and any other policies incorporated into this agreement.
Choice of Law
These Terms and any disputes arising from the use of the Site are governed by and construed according to the law of the state of Arizona. Each party agrees to submit to the courts of the state of Arizona and that the state of Arizona has personal jurisdiction over the matter.
Severability
If any provision of this Agreement becomes or is adjudicated to be invalid or unenforceable in any respect, all remaining provisions will continue to be valid and enforceable. To the greatest extent possible, the invalid or unenforceable provision will be interpreted to eliminate any invalidity or unenforceability in a manner consistent with both its original terms and the intent of the parties as manifested by the remaining provisions.
